1. Parties and Scope
These terms govern holiday home bookings made through Happy Travel Management S.L. (CIF B70986443, Calle el Montículo, 8, 29631 Benalmádena, Málaga, Spain — "Happy Travel"). Accepting these terms and the cancellation policy is required before completing a booking.
2. Nature of the Service
Happy Travel directly offers short-term tourist rentals of holiday homes on the Costa del Sol. The accommodation contract is concluded between the guest and Happy Travel.
3. Booking and Conclusion of Contract
A booking becomes final upon selecting dates, providing guest details and successful completion of payment. The confirmation email is the record that the contract has been concluded. If the selected dates turn out to be unavailable at the moment of payment, no charge is made and no contract arises.
4. Prices
The final price shown includes all mandatory fees and taxes (as required by EU consumer law); no surprise charges appear at checkout. Prices are in euros (EUR). Nightly prices on listing cards are starting prices; the exact amount is determined by a live quote for your dates and party size. Any active promotional discount is shown already reflected in the amount charged.
5. Payment
Payments are taken via Stripe with Strong Customer Authentication (SCA/3DS). The amount is first authorised (blocked); it is only captured once the booking is confirmed. Card details are never stored on Happy Travel systems.
6. Information on the Right of Withdrawal
Pursuant to Article 16(l) of Directive 2011/83/EU and Article 103(l) of the Spanish TRLGDCU, the 14-day right of withdrawal DOES NOT APPLY to accommodation services booked for a specific date or period. Cancellations are governed by the Cancellation Policy displayed clearly during booking.
7. Guest Obligations
The guest undertakes to use the home with care, within the maximum occupancy stated in the listing, respecting house rules and neighbourhood regulations, observing check-in/check-out times, and to provide accurate information. Material breach of house rules may result in termination of the stay without compensation.
8. Liability
Happy Travel is liable for damage caused by its own fault within the framework of applicable law; nothing in these terms limits mandatory consumer rights. In cases of force majeure the parties will seek a mutual solution.
9. Applicable Law and Disputes
These terms are governed by Spanish law. Consumers retain the jurisdiction of the courts of their place of residence. The EU online dispute resolution platform is available at https://ec.europa.eu/consumers/odr.
